Memmer, who was sentenced to serve two life sentences for the murders, appealed, but the state’s Court of Appeals upheld his convictions. In 2004, Memmer applied for postconviction relief on 13 claims of ineffective assistance of counsel. The postconviction relief court denied and dismissed Memmer’s application, and he appealed that decision.

His appeal included only one new claim that he had not raised before. Memmer argued that his life sentences are illegal because the jury was not properly instructed on the elements they had to find in order to convict him of each charge.

The Court of Appeals, in its ruling, said this “newly asserted claim is simply his prior ineffective-assistance-of-counsel claim recast.”
